NoMistake is an AI-powered tool designed to assist with shop drawing review. It is NOT a substitute for professional human review. All outputs, findings, and recommendations generated by NoMistake should be treated as suggestions only and must be independently verified by a qualified professional before any action is taken. By using this Service, you explicitly acknowledge and accept this limitation.

Nature of the Service

NoMistake uses artificial intelligence (including computer vision and large language models) to analyze shop drawings for potential errors, inconsistencies, and standards compliance issues. While we strive for the highest possible accuracy, AI technology has inherent limitations and is constantly evolving.

Limitation of Liability

To the maximum extent permitted by Australian law (including the Australian Consumer Law where applicable), NoMistake, its operators, directors, employees, agents, and affiliates shall not be held liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to:

Maximum aggregate liability: In no event shall NoMistake's total liability for all claims exceed the amount paid by the user to NoMistake in the twelve (12) months preceding the claim.

Assumption of Risk

By using NoMistake, you expressly assume all risks associated with the use of AI-generated review results. You agree that you have been fully informed of the limitations of the Service and have made an informed decision to use the Service despite these limitations.

Our Commitment

We are continuously improving our AI models based on user feedback and real-world data. If NoMistake produces an incorrect finding, please use the feedback feature to report it. This helps us improve accuracy for all users. We are transparent about our limitations and committed to providing the best possible AI-assisted review tool.

Section 02

Terms of Service

1. Acceptance of Terms

By accessing or using the NoMistake platform ("Service"), you agree to be bound by these Terms of Service, the AI Disclaimer, the Privacy Policy, the Data Usage & AI Training Rights, the Intellectual Property terms, and the Refund Policy (collectively, the "Agreement"). If you do not agree to all sections of this Agreement, you may not use the Service. These terms apply to all users, including free trial users and paid subscribers.

2. Description of Service

NoMistake provides AI-powered shop drawing review services for the joinery and cabinetmaking industry. The Service includes automated drawing analysis, error detection, PDF markup reports, cross-checking against architect drawings, project management tools, and related features as may be added or modified from time to time.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality and security of your account credentials. You must be at least 18 years old to create an account. You are responsible for all activity that occurs under your account, whether authorized or not. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans & Credits

Quick Review: Users receive 3 free review credits upon signup. Additional credits can be purchased in packs (5, 15, or 50 reviews). Purchased credits do not expire but have no cash value and are non-transferable.

Pro Workspace: Monthly subscription providing unlimited reviews, project management, and team features. Billing is monthly and auto-renews unless cancelled before the next billing date. Launch pricing may be offered for a limited period as specified at the time of purchase; after the promotional period, the standard rate applies automatically.

Pricing changes: NoMistake reserves the right to modify pricing at any time. Existing subscribers will receive at least 30 days' notice before any price increase takes effect on their account.

You are solely responsible for all content you upload, submit, or transmit through the Service ("User Content"). You represent and warrant that you have all necessary rights and permissions to upload such content and that your User Content does not infringe on any third party's intellectual property rights, privacy rights, or other legal rights.

You agree to indemnify, defend, and hold harmless NoMistake, its operators, directors, officers, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use or misuse of the Service
  • Your reliance on AI-generated review results without independent professional verification
  • Any third-party claims resulting from drawings you reviewed using the Service
  • Your violation of these Terms or any applicable law
  • Any claim that your User Content infringes third-party rights
  • Manufacturing, construction, or other downstream decisions made based on NoMistake's outputs

8. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. NOMISTAKE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION OBTAINED FROM NOMISTAKE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

9. Beta & Early Access Features

NoMistake may offer features designated as "beta," "early access," "preview," or similar. Such features are provided for evaluation purposes and may contain bugs, errors, or inaccuracies. NoMistake makes no representations or warranties regarding beta features and may modify or discontinue them at any time without notice. Use of beta features is entirely at your own risk, and the limitation of liability provisions in this Agreement apply with full force to beta features.

10. Service Modifications

NoMistake reserves the right to modify, update, suspend, or discontinue any aspect of the Service at any time, with or without notice. This includes changes to features, AI models, review algorithms, user interface, pricing, and availability. We will make reasonable efforts to notify users of material changes. Continued use of the Service after modifications constitutes acceptance of those changes.

11. Service Availability & Force Majeure

We aim to provide reliable, continuous access to the Service, but do not guarantee uninterrupted availability. NoMistake shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet outages, power failures, third-party API outages (including AI provider outages), cyberattacks, pandemic, war, terrorism, or labour disputes.

We may suspend or terminate your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could harm NoMistake or other users. You may cancel your account at any time. Upon termination:

If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

This Agreement (including all sections referenced herein) constitutes the entire agreement between you and NoMistake regarding the Service and supersedes all prior agreements, understandings, and representations.

15. No Waiver

The failure of NoMistake to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by NoMistake.

16. Assignment

NoMistake may assign or transfer this Agreement, in whole or in part, without restriction. You may not assign or transfer any rights or obligations under this Agreement without NoMistake's prior written consent.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

18. Dispute Resolution

Informal Resolution: Before initiating any formal dispute, you agree to contact NoMistake at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Mediation: If the dispute is not resolved informally, either party may submit the dispute to mediation administered by the Australian Disputes Centre (ADC) in Sydney, New South Wales. The costs of mediation shall be shared equally.

Jurisdiction: Any disputes that cannot be resolved through mediation shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Class Action Waiver: To the maximum extent permitted by law, you agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.

19. Governing Law

This Agreement is governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Data Usage & AI Training Rights

You acknowledge that the use of your data to improve NoMistake is part of the value exchange of using the Service (whether free or paid). You are not entitled to any additional compensation, revenue share, royalty, or other payment for the use of your data as described in this section.

6. Competitive Use

The insights, patterns, and model improvements derived from your data may benefit all NoMistake users, including users who may be your competitors. By using the Service, you accept this and waive any claims related to competitive advantage derived from aggregated learning.

7. Opt-Out Limitations

Due to the nature of machine learning and AI model training, it is not technically feasible to opt out of data usage for AI improvement while continuing to use the Service. If you do not consent to this data usage, you must not use the Service. The only way to prevent future data usage is to stop using the Service and delete your account.

8. Third-Party AI Providers

NoMistake uses third-party AI services (currently Anthropic's Claude API) to process drawings. By using the Service, you acknowledge that your drawings are transmitted to these providers for analysis. These providers have their own data handling and privacy policies. NoMistake is not responsible for third-party providers' data practices, though we select providers with strong data protection commitments.

Privacy Policy

Account Information: Name, email address, company name (if applicable), and hashed password. We never store your password in plain text.

Uploaded Drawings: PDF files you submit for review. These are processed by our AI engine and stored to deliver the service and improve our models.

Usage Data: Review history, findings, feedback on results (correct/incorrect markings), project and room data, interaction patterns, feature usage, and session duration.

Technical Data: IP address, browser type and version, device information, operating system, referring URLs, and cookies necessary for the functioning of the Service.

Payment Data: Subscription type, billing dates, and transaction history. Credit card details are processed and stored by Stripe; we do not have access to full card numbers.

Communications: Emails, support requests, and feedback submitted to NoMistake.

Your data may be processed in countries where our infrastructure providers operate, including the United States (for AI processing via Anthropic) and other regions where Railway operates servers. By using the Service, you explicitly consent to these international data transfers. We take reasonable steps to ensure that data transferred internationally is treated securely and in accordance with this Privacy Policy.

11. Data Breach Notification

In the event of a data breach that is likely to result in serious harm, we will notify affected users and the OAIC in accordance with the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth). Notification will occur as soon as practicable and no later than 30 days after becoming aware of the breach.

Users retain ownership of their original drawings and project data uploaded to the Service, subject to the license granted in Section 03 (Data Usage & AI Training Rights). NoMistake does not claim ownership of your original drawings.

Review results, findings, marked-up PDFs, cross-check reports, and other outputs generated by NoMistake's AI engine ("AI Outputs") are provided as part of the Service. You are granted a non-exclusive, non-transferable license to use AI Outputs for your internal business purposes. You may not:

Refund Policy

Credit Packs (Quick Review)

Credit pack purchases are non-refundable once any credit from the pack has been used. If no credits from a purchased pack have been used, you may request a full refund within 14 days of purchase. After 14 days, all credit pack purchases are final.

Pro Workspace Subscription

Pro subscriptions are billed monthly. You may cancel at any time, and your access will continue until the end of the current billing period. We do not offer partial refunds for unused portions of a billing cycle. No refund will be issued for months in which the Service was available and accessible, regardless of actual usage.

If you experience a significant, verified service issue (extended downtime exceeding 48 hours, critical bugs that prevent all usage) during a billing period, you may request a pro-rated credit at our sole discretion.

Free Credits

The 3 free review credits provided upon signup have no monetary value and are not eligible for refund, transfer, or exchange.

Launch Pricing

Users who subscribe during the launch pricing period are locked into the promotional rate for the specified promotional period (as communicated at the time of purchase). After the promotional period ends, the subscription will automatically renew at the then-current standard rate unless cancelled before the end of the promotional period. It is the user's responsibility to cancel before the promotional period ends if they do not wish to continue at the standard rate.

Chargebacks & Disputes

If you initiate a chargeback or payment dispute with your bank or payment provider without first contacting NoMistake, we reserve the right to immediately suspend your account and pursue recovery of the disputed amount plus any associated fees. Please contact us at [email protected] before initiating a chargeback.

How to Request a Refund

Contact us at [email protected] with your account email and a description of the issue. We aim to respond to all refund requests within 5 business days. All refund decisions are at NoMistake's sole discretion, except where required by Australian Consumer Law.

Australian Consumer Law

Nothing in this Refund Policy excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded by agreement. If the Australian Consumer Law provides you with a remedy that this policy would otherwise exclude, the Australian Consumer Law prevails.
